Novart Studio Terms of Use
Welcome to Novart Studio. These Terms apply to your access to and use of the website, creative studio, asset library, developer/API center, internal notifications, recharge and redemption features, and related services made available through https://www.novartspace.art. By visiting, registering, signing in, calling the API, uploading reference images, submitting prompts, or downloading generated results, you agree to be bound by these Terms.
1. Scope
These Terms form a legal agreement between you and the current operator of Novart Studio regarding your use of the Service. If you do not agree to these Terms, please stop using the Service. You represent that you have the legal capacity required to accept and comply with these Terms. If you are a minor, you must use the Service with the consent and supervision of your parent or guardian.
2. Services
The Service currently includes the following features, which may be added to, modified, suspended, or removed from time to time:
- Studio: submit prompts, upload reference images, create image generation tasks, and review task status.
- Asset Library: preview and download recent generation results within the applicable retention period.
- Developer/API Center: create API keys, review API documentation, inspect results, and request higher limits.
- Account Functions: sign-in, registration, account settings, internal messages, referral rewards, recharge, and redemption.
Public registration is currently enabled. New accounts must complete email verification before sign-in.
3. Account, Credentials, and Security
- You must provide a lawful, valid, and reachable email address and keep your password, session status, and API keys secure.
- You may not lend, lease, sell, transfer, or share your account, API key, redemption code, or any other access credential.
- You are responsible for activity carried out through your account. If you believe your account or API key has been compromised, you should change your password, rotate keys, and contact the site operator immediately.
- To protect security and stability, we may impose limits on sign-in, registration, request rate, concurrency, task volume, and balance consumption.
4. Acceptable Use and Prohibited Conduct
You may use the Service only for lawful and proper purposes and in compliance with these Terms, applicable law, and relevant third-party platform rules. You must not:
- submit unlawful, infringing, fraudulent, harassing, hateful, pornographic, violent, defamatory, or otherwise inappropriate content;
- upload any image, mark, likeness, work, data, or other material that you do not have the right to use;
- attempt to generate, forge, or distribute ID photos, identity documents, certificates, seals, stamps, or other high-risk imitation materials;
- abuse the website or API at scale, evade rate limits, bypass risk controls, avoid payment, scrape backend data, or maliciously consume system resources;
- scan, attack, penetrate, reverse engineer, inject into, access without authorization, disrupt, or otherwise interfere with the Service or other users;
- use the Service for illegal business, automated cheating, spam, misleading promotion, or any purpose that may create risk for the operator, users, or service providers.
5. User Inputs, Reference Images, and Generated Output
- You are responsible for your prompts, reference images, webhook URLs, descriptions, and any other input you provide, and you represent that you have the rights, licenses, and permissions needed for such content.
- To provide generation, compression, review, caching, storage, callback, display, and download functions, you grant us a non-exclusive license to process such content to the extent reasonably necessary to operate the Service.
- Generated results may resemble outputs received by others and may be affected by model behavior, third-party services, review policies, delay, or failure.
- Except as otherwise required by law, you are responsible for evaluating the legality, merchantability, fitness, accuracy, and potential infringement risks of generated results before using or publishing them.
- The Service does not guarantee that outputs are unique, registrable, exclusive, error-free, or free from similarity to third-party expression.
6. API and Developer Center
- Developer features are only for authorized accounts. You must store and rotate API keys responsibly and must not embed them in public clients, public frontend code, or open repositories.
- You must ensure your API requests, webhook endpoints, and downstream use cases comply with applicable law and these Terms, and you may not use the API to bypass website restrictions or risk controls.
- API usage may be subject to request-per-minute limits, concurrency limits, daily caps, balance requirements, model permissions, and other operational rules. Requests may be rejected, queued, failed, or cancelled if limits are exceeded, the account is restricted, payment is insufficient, or upstream services are unavailable.
- You are responsible for your own application security and webhook endpoint availability. Losses caused by your callback configuration, downstream business logic, or third-party system failures are your responsibility.
7. Recharge, Balance, Bonus, Redeem Codes, and Referral Rewards
- The Service may provide usable platform credits through balance recharge, bonus credits, redemption codes, recharge cards, or referral rewards.
- Account balance and bonus credits are only for use within the Service under the published rules. They are not bank deposits, stored-value financial products, securities, or interest-bearing assets, and are generally not redeemable for cash unless required by law.
- Pricing, consumption rules, promotional conditions, bonus rules, and applicable scope are determined by the current page display, purchase page, public notice, or operator announcement at the relevant time.
- If you recharge or purchase through a third-party store, payment page, or external channel, payment processing is governed by that third party. Within the Service we mainly record your redemption, crediting, and consumption information.
- Except where required by law, expressly promised by the operator, or caused by a clear billing error, credits that have already been issued and consumed are generally non-refundable and non-cashable.
8. Risk Control, Suspension, Ban, and Termination
To protect the platform, users, and third-party providers, we may take measures such as verification, rate limiting, temporary suspension, temporary ban, permanent ban, API key revocation, upload restriction, service termination, or removal of content based on risk control signals, complaints, audits, abnormal traffic, prohibited content, abuse, malicious testing or attacks, unpaid usage, or other reasonable causes.
- A restriction may be applied for minutes, hours, days, or permanently, and may include a reason.
- Once a ban is triggered, website task submission, API usage, and related generation flows may be restricted immediately.
- Temporary restrictions may be lifted automatically upon expiry. Serious, repeated, or high-risk violations may result in permanent loss of access.
9. Third-Party Services and External Links
The Service relies on or may integrate third-party models, inference providers, storage services, email services, callback processing, hosting, external stores, and infrastructure providers. To complete task processing, we may send your prompts, reference images, task parameters, callback addresses, required logs, and result data to such providers.
The availability, output quality, billing rules, and compliance rules of third-party services are not controlled solely by us. External links, store pages, and supplier services are governed by their own terms and privacy policies.
10. Intellectual Property
- The website, interface, code, text, graphics, marks, backend structure, and related operational materials of Novart Studio are owned by the operator or its lawful licensors.
- Except as necessary to use the Service normally, you may not copy, sell, adapt, mirror, repost, publicly distribute, or commercially exploit protected Service content without prior written permission.
- You retain the rights you lawfully hold in your inputs. However, the minimum rights required for platform-side display, caching, review, risk control, and download delivery will continue until the relevant data is deleted or anonymized.
11. Disclaimer
The Service is provided on an “as is” and “as available” basis. We strive to keep the Service stable, but we do not guarantee uninterrupted availability, absolute security, error-free operation, or that model output will meet all of your expectations. We may suspend or adjust the Service due to third-party instability, network issues, upgrades, force majeure, content review, account anomalies, supplier policy changes, or other circumstances beyond reasonable control.
12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages, including loss of profit, loss of goodwill, data loss, service interruption, or third-party claims. If the law does not allow a full exclusion, our aggregate liability in connection with a dispute will not exceed the amount you actually paid for the relevant Service in the three months before the event giving rise to the claim.
13. Changes to These Terms
We may update these Terms based on business changes, product adjustments, legal requirements, or security needs. Updated versions will be posted on this page and will take effect on the publication date or other stated effective date. Your continued use of the Service after the update means you accept the revised Terms.
